This Privacy Policy (“Privacy Policy”) outlines A&A’s approach to data collection, processing, retention, and protection to fulfil its obligations under the applicable laws in force in India including the Information Technology Act, 2000, Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, Digital Personal Data Protection Act, 2023 and allied rules and regulations, as amended or substituted, from time to time. This Privacy Policy applies to your electronic / digital Personal Information (as defined herein below) which is processed by us.

While you may be able to browse A&A’s website (hereinafter referred to as the “Platform”) from countries outside of India, however, please note that our products and services are intended to be offered primarily within India. By accessing or using the Platform and voluntarily providing the information, you acknowledge that such information will be processed in accordance with this Privacy Policy.

Throughout this document, “we”, “us”, “our”, “ours” refers to M/s Ark and Arts (“A&A”). The terms “User”, “End User”, “you”, or “your” have been used to refer any natural person accessing or using the Platform.

1.1 Who We Are

A&A is a sole proprietorship concern duly registered on 29.08.2025 as a ‘Micro Enterprise’ with the Ministry of Micro, Small and Medium Enterprises, Government of India engaged inter alia in the business of interior designing, consultancy, decoration, sale of decorative items and other ancillary or related activities (“Business”) with Ms. Ankita Baid as its sole proprietor, having Udyam Registration Number UDYAM-WB-10-0174582 its official address at 619 Lake Gardens. First Floor. Above Lake Gardens post office Kolkata – 700045, West Bengal. The Platform has been developed, owned and operated by A&A and / or its affiliates, associates, technical, service and business partners, to conduct its Business.

1.2 Roles We Play

We play the roles of a data fiduciary and a data controller (wherever applicable) when we collect and process your Personal Information in furtherance of our Business.

We commit to protecting your privacy and hence our Personal Information handling practices are continually reviewed to ensure compliance with the applicable privacy laws and regulations in force in India.


2. PERSONAL AND OTHER TECHNICAL INFORMATION

The information we learn, receive and gather from you is used to register or open your account, verify your identity to permit you to use the Platform, undertake transactions (including facilitation and processing of payments), communicate with you, respond to your requests, convey any promotional offers, services or updates associated with A&A, and generally maintain your accounts with us. As per applicable laws in force in India, we also use this information to customize and improve your experience with A&A.

We receive and store any information you provide while using the Platform or give us in any other way. You can choose not to provide certain information, however, in such a scenario you might not be able to use the Platform or any of its associated services.

For example, like many websites and mobile applications, we use ‘cookies’, and we obtain certain types of information when your web browser accesses our services. Depending upon the jurisdiction from where you might be accessing our Platform and as per the applicable laws, you may be served different types of cookies such as strictly necessary cookies, performance cookies, etc. For example, if you are an international user accessing our Platform, we only collect strictly necessary data for the functioning of our Platform.

II. Other Technical Information:

(ii) Technical details such as device information, location and network carrier when you use our mobile applications;

(iii) Communications details such as the metadata and other Personal Information we get from communications done through e-mails, SMS, instant messages and calls; and

By using the Platform and / or by providing your information, you agree and consent to us collecting, storing, processing, transferring, using and sharing of your Personal Information (including sensitive personal information as per applicable laws) and other Technical Information listed above that you disclose on the Platform with third parties or service providers for the purposes set out and in accordance with this Privacy Policy.

(i) We use your Personal Information to take and handle orders, deliver products and services, process payments, and communicate with you about the orders, products and services, and promotional offers.

(iii) We use your Personal Information to recommend features, products, and services that might be of interest to you, identify your preferences, and personalize your experience with us.

(iv) We use your Personal Information to communicate with you in relation to A&A’s products and services via different channels i.e. by phone, e-mail, WhatsApp chat, etc.

(v) We use your Personal Information to display interest-based advertisements for features, products, and services that might be of interest to you.


3. COOKIES AND OTHER TRACKERS USED BY OUR DIGITAL PROPERTIES
